class="ez-toc-section-end">

A traumatic brain injury, or TBI, can result from a bump, blow or jolt to the head that disrupts brain function. Injuries range from concussion to more severe trauma. Not every head impact causes a TBI, and not every brain injury is traumatic; oxygen-deprivation injuries involve a different mechanism.

Vehicle and pedestrian crashes: children may be injured in collisions, including on Tampa roads such as I-275, I-4 and Dale Mabry Highway. Proper restraints reduce risk but cannot prevent every injury.

Falls and unsafe premises: playground equipment, stairs and other hazards can be involved. Responsibility depends on the condition, notice and applicable duty—not simply where the fall occurred.

Sports and recreation: a collision or fall may require medical assessment. Inadequate supervision or failure to respond appropriately may warrant investigation, but ordinary participation risks do not automatically mean negligence.

School and daycare incidents: records may help establish supervision, the incident timeline and how staff responded.

Symptoms and when to seek medical care

Symptoms may include headaches, dizziness, sleep changes, irritability, trouble concentrating or changes in school performance. Younger children may struggle to explain what feels wrong. Some symptoms appear immediately; others are noticed later. A medical professional should assess a suspected injury and give individualized recovery and school-return guidance.

Seek emergency care immediately for danger signs after a head injury, including a worsening headache that does not go away, repeated vomiting, seizures, increasing confusion, weakness, inability to wake up or unequal pupils. Call emergency services when appropriate. This article is not a substitute for medical assessment.

Medical imaging is not an automatic requirement

Clinicians decide whether CT, MRI or other testing is needed based on the child’s symptoms and examination. Routine imaging is not recommended solely to diagnose a mild TBI. A normal scan does not rule out concussion. Advanced imaging, including diffusion tensor imaging, is not a stand-alone test proving that a particular incident caused an individual child’s injury.

Evidence that may help explain what happened

A useful investigation looks at both the event and the child’s recovery. Preserve records without delaying treatment:

Medical notes, discharge instructions, imaging when clinically obtained, rehabilitation records and bills.

Incident reports, photographs, available surveillance footage and witness contact details.

School records and observations from teachers or caregivers showing changes from the child’s earlier functioning.

Specialist or neuropsychological assessments when recommended, and documented support needs over time.

Experts may be needed to distinguish injury-related changes from pre-existing conditions or other causes. Neither a scan nor a change in grades establishes legal causation by itself.

Bringing a claim and protecting the child’s recovery

An adult representative generally acts on the child’s behalf in litigation. Claims involving public schools or other government defendants have special notice, immunity and filing rules. Medical-negligence claims follow a different process from an ordinary accident claim. The proper representative, defendant, court and deadline require an individual review.

Florida has safeguards for settlements involving minors. Court approval, appointment of a guardian ad litem and a property guardianship are separate questions. What is required depends on factors such as the gross settlement, the amount remaining for the child and whether a lawsuit has been filed. A structured annuity is not an automatic substitute for legally required approval or guardianship.

What losses may be considered?

A supported claim may include medical and rehabilitation expenses, necessary future care, impairment of future earning capacity, pain and suffering, and loss of enjoyment of life. Long-term projections need reliable medical and economic evidence. Recovery is not guaranteed, and available damages depend on the facts and applicable law.

Frequently asked questions

Can I wait until my child turns eighteen to seek legal advice?

No. Do not assume that a child’s age pauses the deadline.
