Under Florida Statutes § 767.04, this applies regardless of whether the dog was ever aggressive before or whether the owner knew it was dangerous. The owner’s liability can be reduced if the victim’s own negligence contributed to the bite, and a clearly displayed “Bad Dog” sign can be a defense in some cases, but not when the victim is under six years old.

<div dangerous. Florida does not. Section 767.04 makes the owner liable for damages suffered by a person bitten while in a public place or lawfully in or on a private place, including the owner’s property, regardless of the former viciousness of the dog or the owner’s knowledge of it. A person is lawfully on property when they are there to perform a duty, such as a mail carrier, or when invited by the owner.

Section 767.01 separately makes owners liable for damage their dogs do to people or animals, which can cover injuries that are not bites, such as being knocked down.

The “Bad Dog” sign defense

Florida gives owners one important defense. If the owner had a sign displayed prominently on the property, easily readable and including the words “Bad Dog,” the owner is generally not liable for a bite on that property. The defense does not apply if the victim is under six years old, or if the bite was caused by the owner’s negligent act or omission, such as leaving a gate open.

When the victim’s actions matter

Section 767.04 says the owner’s liability is reduced by any percentage of fault attributed to the victim. Examples insurers raise include provoking or teasing the dog, ignoring warnings, or reaching over a fence. Florida’s general comparative fault statute, § 768.81, also bars recovery when a plaintiff in a negligence claim is more than 50% at fault, and insurers may argue it applies.

Who else can be responsible?

Landlords may be liable in some situations, for example when they knew of a dangerous dog and had control over the premises.

Dog sitters, groomers or businesses caring for the dog may share responsibility.

Parents of a minor who owns the dog may be involved in the claim.

Dangerous dog rules

Florida also has a dangerous dog process under §§ 767.11–767.13, run by local animal control. A dog that severely injures a person can be classified as dangerous, and further attacks carry criminal penalties.
